What does a probate real estate agent do in Colorado?
A PROBATE REAL ESTATE AGENT ORGANIZES THE SALE. FIRST, CONFIRM WHO CAN SIGN.
A probate real estate agent coordinates the sale of a house administered through an estate: documenting condition, arranging access, comparing repair and sale options, pricing, marketing and negotiating.
First, the estate attorney and title company should confirm who can sign and review the personal representative's Letters and any restrictions.
Not every inherited house passes through probate; joint tenancy with a surviving owner and beneficiary deeds can follow another route.
Robert handles the property and sale plan; legal authority, creditor claims and distributions belong with estate counsel.
PROBATE · SHOWN
Four parts of the property plan. Confirm the signing authority and timing with estate counsel before making commitments.
- 01LETTERS
The document the listing rests on
For a house administered through probate, confirm the personal representative's Letters and any limits with estate counsel and the title company before signing a listing contract. Ask counsel which protective or preparatory steps can proceed while appointment is pending.
- 02PROTECT
Insurance, access, utilities
Vacancy coverage on the actual address, keys controlled, utilities on. The estate is paying from day one, and a vacant house without coverage is the fastest way to lose value the family never sees.
- 03AGREEMENT
In writing, with a number
Since 2026-08-12 a Colorado broker needs a signed written agreement stating compensation before any licensed duty (HB26-1426). The number is negotiated, not inherited.
- 04SALE
Inside the statute
Ask the estate attorney to review any proposed purchase by the personal representative or a related party, creditor claims and instructions for sale proceeds before committing to terms.
The promise: the authority comes from the court's Letters, not from a certificate.
Colorado licenses real estate brokers; it does not license probate specialists. The state's lookup shows one broker license per person and no probate endorsement on it, so a probate specialist designation is a private course, not a state credential (PROBABLE; check any agent on the Division of Real Estate lookup). What is special about a probate sale is the seller, not the salesperson. The probate process does not change what the house is; it changes who can sign for an estate asset, and probate property sells on the same market as any other house once the Letters exist.

The seller is the personal representative, and the power to sell arrives with the court's Letters. Until the appointment ends, a personal representative has the same power over the title to estate property that an absolute owner would have, without a court order (C.R.S. 15-12-711, VERIFIED), limited only by a restriction in the will or an order in a formal proceeding (C.R.S. 15-12-715, VERIFIED). A power of attorney the decedent signed ended at death (C.R.S. 15-14-710, VERIFIED); nobody lists on it.
Start with the deed and the estate documents. Colorado Courts distinguishes property passing through probate from joint tenancy with a surviving joint tenant and beneficiary-deed property. Ask the attorney and title company which route applies before assuming Letters are the only possible authority.
The proof: what the job is, in order, with the statute beside each step.
Confirm the signing authority with estate counsel and the title company. While appointment is pending, ask counsel which protective or preparatory steps are appropriate. Build a property record: insurance and vacancy status, access, utilities, visible condition, permits, systems and known repairs. Record who may approve work and how bills will be paid.

Then the agreement. Since 2026-08-12 a Colorado broker may not perform licensed duties without a signed written agreement stating the amount or rate of compensation (HB26-1426), and the personal representative signs it in that capacity. Then the price, against what closed and against the clock: the Denver metro median days on market was 57 in August 2026 (VERIFIED, Realtor.com via FRED, on the days on market page), and the creditor notice period keeps running in the background, four months from first publication or one year from death (C.R.S. 15-12-801, VERIFIED).
If an heir, the personal representative or a related party wants to buy, take that proposal to the estate attorney before negotiating a commitment. Counsel should review conflicts, any required approvals, creditor claims and distribution instructions. The agent coordinates the sale; the agent does not decide those legal questions.
The plan: five questions, then describe the property.
Ask for five specific answers. Show me the Letters you will list on, and tell me what you do if they have not issued yet. What changes on day one for insurance, keys and utilities, and who pays for it. How will you price a vacant house against the listings active the week we launch, not against the neighbor's sale from two summers ago. If an heir wants to buy it, what is the procedure and who approves it. And what does your listing agreement say about compensation, as a number.

Ask the agent to separate the property plan from the legal decisions that need counsel. Tell Robert where the house is, whether it is occupied and what timing you are considering. If a personal representative has been appointed, include that status; no private estate documents are needed for an initial conversation.

WHERE ROBERT STOPS
Robert can read the house, the carrying cost and the sale sequence, and he can list an estate's house on the personal representative's Letters. Appointment, will restrictions, disputes among heirs, creditor claims and distribution belong with the estate attorney; basis and reporting belong with the CPA.
